General

Use of this site means that you are above 18 years old and that you possess the legal right and ability to use this site in accordance with the terms and conditions set herein. By using this site you agree to be bound by the terms and conditions set out herein. All information contained in this site is either our property or we have acquired right for use of such information. Parties to this Agreement

This agreement regulates the use of our web site and the services provided. The services of myHellas.com provide information concerning the price and availability of hotels, together with a range of other information to assist you in making a hotel reservation.

Prices, restrictions and availability of goods and services may change without notice and reservations are subject to applicable taxes and fees. By completing the information boxes and clicking confirm on the reservation page you are entering into a contract with myHellas.com for the provision of all the services of the site. Unless otherwise agreed or specified, myHellas.com does not charge users any fee for the provision of its services (use of site). You may withdraw from your contract with myHellas.com for the services at any time without any cost to you by notifying us by email.

Separate terms and conditions might apply to your reservation and the services that you select. You hereby agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payments of all amounts when due and to compliance with the supplier's rules and restrictions regarding availability and use of fares, products or services. Any violation of such supplier's conditions of purchase may result in cancellation of your reservation or purchase, in your being denied access to any flights, hotels, vehicles, in your forfeiting any amount paid for such reservation or purchase and in myHellas.com debiting your account for any costs we shall incur as a result of such violation.

General

If you are using a debit or credit card, please call your bank as soon as your reservation is confirmed, and make sure to raise the daily allowed spending limit to cover the total purchase amount, if applicable. By confirming the reservation, the customer assumes the burden of proof. If the customer wishes to dispute a charge on a credit card for travel services purchased, shipping or handling charges, taxes, and other fees outlined to the customer during the booking process, the customer agrees the bank should not make such a charge back against our company, our ticket processor, or the airline, until we discuss the charges with the bank and the burden of proof is met. We also reserve the rights to report fraudulent credit card activity and invalid disputes to the appropriate authorities and credit bureaus.

All Fraudulent Credit Card Transactions are tracked electronically through multiple channels and are reported to Airline Security, Airport Police and all law enforcement agencies.

Indemnification

To indemnify us for claims for intellectual property rights infringement or defamation you agree and acknowledge that

In case of an individual booking or multiple bookings you are the one responsible for all legal and financial obligations towards us;
You cannot transfer any of the rights or obligations arising from this agreement;
You can only retrieve, display, save or print individual pages of our site;
You will not copy, place on a server, distribute or sell any of the information contained in the site;
Our suppliers and partners are independent contractors and not employees or agents of ours;
We provide you with agent services only via our online research, availability and accommodation system;
When you proceed with a reservation you are bound by the terms and conditions of the hotel booked in addition to the general booking conditions listed in this website;
You shall indemnify us, including our officers, suppliers and agents or other partners from and against any and all liabilities, expenses, legal and attorney's fees and damages arising out of claims resulting from your use of the site and/or any material you post to or transmit through the site or its servers;

The reservations facilities of this site shall be used for the sole purpose of making legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. You understand that abuse of the reservation facilities of the site may result in your being denied access to such facilities;
You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this site.

Limitation of Liability

This site is provided on an as is basis. Given the complexity and vulnerability of the use of the Web, we do not guarantee the accuracy nor the availability or timeliness and completeness of this site or that it is not infected by viruses. Given all the above, we are not liable for any direct or indirect damages that you might suffer from the use or from your inability to use this site. In cases where our site contains links to sites of our partners, suppliers, agents or others, we are not responsible for either their availability, accuracy, performance or any action that might cause any damage to you. Links and access to sites of our partners are provided for your convenience only. We do not give any undertaking as to whether a hotel will be able to cater for those who require special diets nor do we give any undertaking as to the suitability of properties for disabled clients. If any member of a party requires a special diet or suffers from a disability appropriate checks should be made before booking to establish that the property chosen is suitable.

Flying times
In your itinerary , flight times are given for guidance only. All departure/arrival times on your flight ticket are provided by the airlines concerned and are estimates only. They may change due to air traffic control restrictions, weather conditions, operational/maintenance requirements and the requirement for passengers to check in on time.
We are not liable if there is any change to a departure/arrival time previously given to you or shown on your ticket or for any other alteration to your flight by the relevant airline. Also, please note that where a sector of a flight itinerary is not utilised without contacting the carrier directly any remaining sectors may be subject to cancellation without further notification. Where this situation arises we are unable to accept responsibility for any costs incurred. It is for this reason that you are required to reconfirm your flights with the airline in accordance with the airline's applicable reconfirmation deadline. For all air travel it is your responsibility to check the departure and arrival times of your flights at the time of travel.
We are unable to make any special arrangements for you if you are delayed as these matters are at the sole discretion of the airline concerned. Please note that the times shown on your ticket or itinerary are the departure times of the flight. Check-in times, as advised by the carrier or in the airlines’ timetable are the latest times at which passengers can be accepted for travel, allowing the necessary time to complete all formalities. Flights cannot be held up for passengers arriving late and no responsibility can be accepted by us or the airline in such cases.

As for the combined bookings, in case of cancellation of one part of the booking due to an external factor (e.g. strike, weather, cancellation on behalf of the airline), myHellas.com cannot guarantee that it can amend the rest of the booking data without any extra charge. In case the user would like to totally amend/cancel the booking, the terms and conditions of the airline company apply. myHellas.com has no liability for the non availability of the service or product, errors, omissions or denial of the supplier, injury, death, property damage or other losses that may result from services supplier, delays, cancellations, overbooking, strike, force majeure that are not in direct control, the privacy policy to any other internet sites, the information provided and published by other suppliers.

Events beyond our control: These include: unusual, unforeseeable or unavoidable events beyond our control, the consequences of which could not be avoided even if all due care has been exercised including but not limited to war, threat of war, riot, civil disobedience or strife, government action, terrorist activity, natural or industrial disaster, fire, adverse weather conditions, level of water in rivers or floods, closure of airports and may also include industrial dispute involving third parties, technical or maintenance problems or unforeseen operational decisions of air carriers such as changes of schedule or any failure in the information technology infrastructure, airline insolvency (including but not limited to our website) or failure in internet connections. Except where otherwise expressly stated in these booking conditions we regret that we cannot accept liability or pay any compensation where the performance of our contractual obligations is prevented or affected by reason of such events beyond our control.

Special Offers, Promotions & Competitions

From time to time, we might make special offers, promotions or competitions available in our site for specific services or products of ours, or of suppliers or partners of ours. All such offers, promotions or competitions are subject to the specific terms and conditions defined thereto. In case no specific terms and conditions come along or they are limited, thus not covering all areas, then the present terms and conditions shall apply.

Advertising & Sponsorships

We shall not accept any responsibility or liability for any content in the site posted by advertisers or sponsors. Sponsors and advertisers are responsible for ensuring compliance with applicable law.

Tax Recovery Charge

The tax charge on myHellas.com Special Rate hotel and car transactions is a recovery of all applicable transaction taxes (e.g. sales and use, occupancy, room tax, excise tax, value added tax, etc) that myHellas.com pays to its vendors (e.g. hotels, car suppliers, etc.) in connection with your travel arrangements. myHellas.com is not the vendor collecting and remitting said tax to the applicable tax authorities. The vendors bill all applicable taxes to myHellas.com and myHellas.com remits such tax directly to the vendor. myHellas.com is not a co-vendor associated with the vendor with whom we book or reserve our customers travel arrangements. Taxability and the appropriate tax rate vary greatly by location. myHellas.coms actual tax cost paid to the vendor may vary from the tax recovery charge, depending upon the rates, taxability, etc. in effect at the time of the actual use of the hotel, automobile, etc. by our customer. Certain jurisdictions impose a hotel occupancy tax or other type of transaction tax upon the renting of a hotel room, an automobile, etc. The type of tax charged by the vendor will vary by service and location.

Cancellations - Changes

The ability to change or cancel a flight ticket, a trip or a different product or service and the conditions governing such a change or cancellation, subject to conditions set by each provider to which myHellas.com has no influence. Costs may arise in case of change or cancellation of a travel service, which is determined by the conditions of each provider. If the supplier provides the user the right to cancel or change a product or service, the user is obliged to inform in writing myHellas.com about the cancellation or change, otherwise myHellas.com may not cancel or modify the reservation. Before each reservation, the user must read and agree with the regulations and restrictions. If a ticket has been issued, myHellas.com changes or cancels it, in accordance to the terms of the supplier. Any charges are the same as those applicable to all travel agencies, depending on the time of cancellation. The service fee for change - cancellation of any service, accords the market trends. Apart from the possible cancellation – change fee from the provider, the charge for myHellas.com (service fee) is defined according to the following:

Change of fare (interior or abroad): 15 euro/ticket
Cancellation of fare (interior or abroad): 15 euro/ticket

The commission paid when purchasing a service in case of cancellation, is non-refundable. In case of cancellation with fault of the supplier, no additional service fee is charged by myHellas.com.

Currency Converter

From time to time, myHellas.com may make available a currency converter in its website. Currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified as accurate, and actual rates may vary. Currency quotes are not updated every day. Check the date on the Currency Converter for the day that currency was last updated.

Jurisdiction, Disputes and Other

When you enter into an agreement with the GR Societe Anonyme (i.e. when you pay in Euro), this agreement shall be governed by the provisions of GR law and the parties hereby agree to submit any dispute arising from this agreement to the Courts of GR. If any of the provisions set out in this agreement is deemed to be invalid by any court having competent jurisdiction, the invalidity of that provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Failure by us or you to exercise any right or remedy under this agreement does not constitute a waiver of that right or remedy. Not withstanding the above mentioned clause, if any part to this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, the invalid or unenforceable provision will be deemed superseded by a valid and enforceable provision that most closely matches the intent of the invalid provision and the agreement shall remain in effect. Any rights not expressly granted herein are reserved.
